Are Your Scheduling Practices Legal?

Organizations in New York are under scrutiny over scheduling practices that require employees to show up or stay home with insufficient notice.

On-call scheduling practices have become popular to meet fluctuating demand. On-call scheduling includes requiring employees to fill shifts or cancelling shifts at short notice. Employers in New York are required to pay employees at least four hours at minimum pay if they show up but are sent home. A number of other states have rules similar to New York.

On Friday, April 10, the Attorney General asked for information on how employees are scheduled to provide details on the processes followed to schedule on-call shifts, whether they penalize employees who do not follow on-call procedures, and for any analysis that they may have conducted on the cost savings associated with on-call shifts and the impact on workers’ well-being.

Good scheduling practices include:

  • Publishing schedules in advance of the work week
  • Providing employees with online access to schedules
  • Avoid changing schedules at short notice
  • Avoid “on call” shifts where employees are required to be available but may not work
